Do you need a financial settlement on divorce?

A key aspect of the divorce process is the separation of joint assets and finances.  While reaching a financial agreement on divorce is not required by law, protecting your current and future interests is strongly advised.  In circumstances where you and your ex partner are unable to agree a financial settlement you can ask a court to decide matters for you, although we will always try to avoid this where possible and agree finances by consent

The process requires transparency from both parties, and there should be a process of exchanging full financial disclosure of your assets.  This would include all assets, including income, property, investments pensions, savings and debts.  This helps you to make an informed decision about any proposed financial settlements.  We can advise on the best and most cost effective way to obtain financial disclosure and will try to avoid costly court proceedings where possible.

A financial agreement can cover multiple areas, including how assets will be divided, living arrangements (especially if one partner will continue to reside in the family home) and child maintenance payments.  It can help couples make a clean break on divorce or set up financial arrangements to cover ongoing needs, such as spousal maintenance.  You may already have a pre-nuptial agreement in place which will need to be considered.

Even if you are amicable with your spouse or have no assets, it is important to ensure that you obtain a clean break as the financial claims you have against each other by virtue of marriage will remain live even after divorce unless dismissed in a court order.  It is therefore important to have a court order setting out the financial settlement and clean break approved by the court to ensure that it is legally binding.  You can only submit a consent order once the conditional order (formerly known as the decree nisi) has been pronounced by the court.
