The Divorce, Dissolution and Separation Act 2020 (DDSA 2020) which came into force on 6 April 2022 introduced the “no-fault divorce” system. Whilst the ground for a divorce or dissolution of a civil partnership remains the same i.e. the irretrievable breakdown of the marriage or civil partnership, it is no longer necessary to rely on one of the five facts to prove this.  Prior to the DDSA 2020, the facts which could be used to prove the only ground for divorce (the irretrievable breakdown of the marriage) were as follows:-

  • Two years’ separation (with consent)
  • Five years’ separation

Further, prior to the DDSA 2020, it was open to the respondent in the divorce to defend the proceedings if he/she so wished. This is no longer possible, and a divorce can now only be defended based on the validity or subsistence of the marriage or civil partnership or where the court does not have jurisdiction to entertain the proceedings.

The DDSA 2020 has changed the terminology around divorce, what was previously called a “divorce petition” is now called a “divorce application”.  The “decree nisi” is now the “conditional order of divorce or dissolution” and the “decree absolute” is a “final order”.  The petitioner is now called the applicant.  Further, for the first time, it is possible for the parties to make a joint application to divorce.
